Registering as a user or placing an order through our online store constitutes your acceptance of these Terms and Conditions and our website's Privacy Policy. If you disagree with the terms and conditions set forth herein, please refrain from registering or making any purchase.

4. Legal capacity

By placing an order through this website, you declare that you are over 18 years of age and have the legal capacity to enter into a contract.

5. Use of our website

By using this website and placing orders through it, you agree to:

• Do not place any false or fraudulent orders. If we reasonably believe that such an order has been placed, we will be authorized to cancel it and inform the relevant authorities.
• Provide us with your email address, postal address, and/or other contact information in a truthful and accurate manner.
• You also agree that we may use this information to contact you if necessary (see our Privacy Policy). If you do not provide all the information we require, we will not be able to process your order.

By entering their personal information on the purchase form, the user must accept the Terms and Conditions and Privacy Policy in order to continue with the purchase process.

All orders are subject to our acceptance, of which you will be informed via email. The contract for the purchase of a product between you and us (the "Contract") will be concluded only when we send you the Purchase Confirmation.

We will not be obliged to supply you with any other products that may have been ordered until we confirm dispatch of the same in a Purchase Confirmation.

7. Availability of products

All product orders are subject to availability. Therefore, if there are difficulties with product supply or if items are out of stock, we will promptly refund any payments you have made for those specific items. In these cases, Sargadelos will not be obligated to deliver those items.

8. Remove or modify products

Sargadelos reserves the right to withdraw any product from this website at any time and to remove or modify any material or content on it. Sargadelos is not liable to you or any third party for withdrawing any product, removing or modifying any material or content on the website, regardless of whether the product has been sold or not.

9. Delivery

The estimated delivery time is 2 to 3 days, for custom orders this time will be 20 to 25 days.

Without prejudice to the provisions of clause 7 regarding product availability, we will endeavor to dispatch your order within the timeframe specified in the Purchase Confirmation. If no date is specified, delivery will be made within 30 days of the Purchase Confirmation date.

If for any reason we are unable to meet the delivery date, we will inform you and give you the option to continue with the purchase by setting a new delivery date or cancel the order with a full refund of the price paid. Please note, however, that we do not deliver on Saturdays or Sundays. The product will be delivered to the address you indicated when placing the order. Because the product will be delivered door-to-door, we cannot accept PO Box addresses.

10. Impossibility of delivery

If we are unable to deliver your order, we will leave you a note explaining where your order is and how to arrange for a reshipment. If you will not be at the delivery location at the agreed time, please contact us to arrange delivery.

Please note that storage and reshipment of your order may incur additional costs. If, after 30 days from when your order is available for delivery, it has not been delivered for reasons not attributable to us, we will understand that you wish to withdraw from the Contract and will consider it terminated.

As a result of termination of the Contract, we will refund the price paid for such products as soon as possible and, in any case, within a maximum period of 30 days from the date we consider the Contract terminated. In these cases, we will be authorized to charge you the shipping costs resulting from the termination of the Contract.

11. Transfer of risk and reservation of ownership

Risk transfers from the moment the product is delivered. Until full payment is made, the items remain the property of Sargadelos.

12. Taxes

The legislation corresponding to the destination of the goods will apply to all tax matters. In mainland Spain, the provision of a Tax Identification Number (NIF), first name, last name, and address is mandatory for orders over €3,000 (VAT included) placed by individuals, and the Tax Identification Number (CIF), company name, and address for orders over €400 (VAT included) placed by companies.

For our international orders, destination duties are not included.

13. Price

The current price of the product will be the one agreed upon at the time the order is placed. In accordance with the provisions of Article 68 of Law 37/1992, of December 28, on Value Added Tax, delivery of the items will be deemed to be located within the territory applicable to Spanish VAT if the delivery address is located within Spanish territory, excluding the Canary Islands, Ceuta, and Melilla.

The applicable VAT rate will be the legally applicable rate at any given time, depending on the specific item. Shipping costs will be added to the total amount and will appear before you confirm your order.

Prices may change at any time, but any changes will not affect orders for which we have already sent you a Purchase Confirmation.

14. Vouchers and promotions

The online store may offer special discounts and promotions on specific products or for a specific customer profile. Each promotion will include the specific information necessary to enjoy it, including validity periods, requirements, restrictions, limitations, or technical, physical, or legal warnings, which will be considered specific conditions.

All promotions show the price of the items without the discount and the same price with the discount applied. The specific terms and conditions of the promotion will indicate whether the price includes shipping costs or not.

In any case, vouchers and discounts generated can only be redeemed through the online store www.sargadelos01.des2.net. Under no circumstances may they be redeemed in cash, nor may they be combined with other promotions or discounts.

15. Payment method

You can pay with Visa, Maestro, Mastercard, PayPal, or bank transfer. By clicking "Accept" you confirm that the credit card is yours.

Credit cards will be subject to verification and authorization by the issuing entity, but if the entity does not authorize payment, we will not be liable for any delay or non-delivery and we will not be able to enter into any Contract with you.

16. Return Policy

16.1 Legal right to withdraw from the purchase

You may withdraw from the Contract at any time within 14 calendar days from the date you receive your order. In this case, you will be refunded the price paid for such products. You will be responsible for the direct costs of returning the product. You may prove your right of withdrawal within the indicated period, using any legally permitted means. Simply send an email to tonline@sargadelos01.des2.net, and our customer service department will contact you with information on how to return the product.

Your right to withdraw from the Contract will apply only to products returned in the same condition as you received them. Please return the item using or including its original packaging. You must also include all documents and packaging. No refund or exchange will be given if the product has been used beyond its initial opening, if it is not in the same condition as when it was delivered, or if it has been damaged in any way. Therefore, you should take care of the product(s) while they are in your possession. No refunds will be given for personalized items. After examining the item, you will be informed whether you are entitled to a refund of the amounts paid.

The refund will be made as soon as possible and, in any case, within 30 days of the date you informed us of your intention to withdraw. The refund will always be made using the same payment method you used to pay for the purchase. You will assume the cost and risk of returning the products to us, as indicated above. This provision does not affect other consumer rights granted by current legislation.

16.2 Returns of defective products

Upon receipt of the product, if you believe it does not comply with the terms of the Contract, you must contact us within two business days of receiving it. We will contact you by phone at 982557841, where we will instruct you on how to proceed, or by sending the return slip to tonline@sargadelos01.des2.net. Please return the item using or including its original packaging.

You must also include all documents and packaging for the products. No refund will be issued if the product has been used beyond its initial opening. The refund will be processed as soon as possible and, in any case, within 30 days of the date you reported your incident to us.

Refunds will always be made using the same payment method you used to pay for the purchase. All rights recognized by current legislation are subject to change.

17. Liability and Exemption from Liability

To the extent permitted by law, we exclude all warranties, except those that cannot be lawfully excluded against consumers and users. Due to the natural materials we use and the way we make our products, the items we sell may often show variations in size, texture, and color; however, these will not be considered defects or flaws.

On the contrary, their presence should be expected and appreciated; natural characteristics are inevitable and must be accepted as part of the product's individual appearance. The provisions of this clause shall not affect your rights as a consumer or user, nor your right to withdraw from the Contract.

18. Intellectual property

You acknowledge and agree that all copyright, trademarks, and other intellectual property rights in and to the materials or content provided as part of the website remain at all times vested in Sargadelos*. You may not use such material unless expressly authorized by us. Downloading and using images from our pages is prohibited without the written authorization of Sargadelos*.

19. Written communications

Applicable regulations require that some of the information or communications we send you be in writing. You agree that most of these communications with us will be electronic. We will contact you by email or provide information by posting notices on this website.

For contractual purposes, you consent to the use of this electronic means of communication and acknowledge that all contracts, notices, information, and other communications we send to you electronically comply with any legal requirement that they be in writing. This condition will not affect your statutory rights.

20. ASSIGNMENT OF RIGHTS AND OBLIGATIONS

This Agreement is binding on both you and Sargadelos*, as well as on our respective successors and assigns. You may not transfer, assign, encumber, or otherwise transfer this Agreement or any of the rights or obligations arising from it without our prior written consent.

Sargadelos reserves the right to transfer, assign, encumber, subcontract, or otherwise transfer a Contract or any of the rights or obligations arising from it at any time during the term of the Contract. Such transfers, assignments, encumbrances, or other transfers will not affect your statutory rights as a consumer.

21. Events beyond our control

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control ("Force Majeure Event"). Force Majeure Events include any act, event, failure to perform, omission, or accident beyond our reasonable control, including, but not limited to, strikes, lockouts, or other industrial action; civil commotion, riot, invasion, terrorist attack or threat of terrorist attack; war (whether declared or not) or threat or preparation for war; fire, explosion, storm, flood, earthquake, subsidence, epidemic, or any other natural disaster.

Inability to use trains, ships, airplanes, motor vehicles, or other means of transport, whether public or private. Inability to use public or private telecommunications systems. Acts, decrees, legislation, regulations, or restrictions of any government or public authority. Strikes, failures, or accidents involving maritime, river, postal, or any other type of transport. Our obligations under the Contracts will be deemed suspended for the duration of the Force Majeure Event, and we will have an extension of the time to perform such obligations for a period equal to the duration of the Force Majeure Event.

We will use all reasonable efforts to bring the Force Majeure Event to an end or to find a solution that allows us to perform our obligations under the Contract despite the Force Majeure Event.

22. Partial nullity

If any of these Conditions or any provision of a Contract were declared null and void by a final decision of a competent authority, the remaining terms and conditions shall remain in force, without being affected by said declaration of nullity.

23. Our right to modify these conditions

Sargadelos* reserves the right to revise and modify these Terms and Conditions at any time. You will be subject to the Terms and Conditions and Privacy Policy in effect at the time you use this website or place an order, unless we are required to make retroactive changes to these Terms and Conditions or Privacy Policy by law or government agency, in which case any changes will also affect orders you have previously placed.

24. Language

Contracts can be concluded in Spanish and English.

25. Applicable legislation and jurisdiction

The use of our website and any contracts for the purchase of products through our website shall be governed by Spanish law. Any dispute arising from or related to the use of the website or such contracts shall be subject to the non-exclusive jurisdiction of the Spanish courts. If you are contracting as a consumer, nothing in this clause shall affect your rights under current law.
